Will Kentucky Ruling Affect Other Casinos
September 29, 2008 - Sandro FreiLawyers representing the 141 online poker and online gambling domain names that are being threatened with forfeiture by the Commonwealth of Kentucky have until the 7th of October to prepare their briefs.
Representatives of the poker sites submitted a brief to the court arguing that poker is a skill game and is therefore legal in Kentucky. Legal teams and lobby groups who represent online casinos will try to demonstrate that the issue before the court is outside of its jurisdiction and should be dismissed
The presiding Judge Wingate has given the defendants until the 7th of October to submit the legal briefs stating their positions
The case is complex and its outcome could set precedents which could effects international online casinos around the globe. At hand are some basic questions
Domain Ownership
Lawyers for the online casinos did not reveal who they are representing except Alice Grimes claimed she represents Goldencasino.com. The two attorneys and others in attendance representing the domain names declined to say who owned those names
Goldencasino.com's representative didn't fear reprisal since that casino has already started actively blocking users of their casino with IP s originating in Kentucky. Spokeswoman Jennifer Brislin relayed that lawyers for Kentucky and Goldencasino.com had met, which lead the online casino site to begin blocking Kentucky users. Goldencasino.com has notified players that they have stopped being accepted in the casino if they are residents of Kentucky, and that users' accounts were being closed
